In this article we will further discuss differences between the state and federal system.

In the United States we have what is known as a dual system of government. The federal government is responsible for certain areas of law making and enforcement while other areas fall to the states. If you violate a law that was passed by the federal government then charges in the Federal District Court will be the result. Cases in the federal system will be handled by the United States Attorney’s Office. The federal system has its own set of rules, procedures, and laws. This means that a rule or protection which may apply to you, in state court, may not be relevant in the federal system. Likewise, a rule or protection that applies to you in federal court may not apply in the state system. This is because the state and federal system are considered to be two different governments.

Other differences between state and federal court include the fact that an attorney licensed in Arkansas state court is not automatically licensed to practice in the federal system. When a defendant is selecting counsel it is important to find someone who is not only licensed in the federal system, but who is also experienced in handling such cases.
